These Terms & Conditions (“Terms”) govern your access to and use of our website, online store, and related services (collectively, the “Services”). By visiting, creating an account, or placing an order, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

2) Eligibility & Accounts

  • Age. You must be at least the age of majority in your jurisdiction to purchase.
  • Account Security. You’re responsible for keeping your login secure and for all activity under your account. Notify us immediately of suspected unauthorized use.
  • Accurate Info. Provide current, complete, and accurate information at checkout and in your account.

3) Orders, Pricing & Payment

  • Offer & Acceptance. Your order is an offer to buy. We may accept or reject orders at our sole discretion (e.g., suspected fraud, out-of-stock, pricing/description errors).
  • Pricing. Prices, fees, and promotions can change without notice. If we find a pricing or description error after you order, we may cancel the order and issue a refund, or contact you for instructions.
  • Taxes & Duties. You are responsible for any applicable sales taxes, VAT/GCT, customs duties, brokerage fees, and import taxes.
  • Payment Processing. Payments are processed by third-party providers. We do not store full card numbers. You agree to their terms and our Privacy Policy.

4) Shipping, Delivery & Risk of Loss

  • Processing Time. Standard processing is typically 1–3 business days (Mon–Fri), unless otherwise stated on the product page or at checkout.
  • Delivery Estimates. Any dates shown are estimates only; carriers may experience delays.
  • Risk of Loss. Risk passes to you upon delivery to the shipping address you provide. Title passes upon our transfer to the carrier, subject to applicable law.
  • Refused/Undeliverable. Orders refused or undeliverable due to incorrect address or inability to receive may be returned to us; we may refund the product price less shipping and handling (if the items are eligible for resale), or reship at your cost.
  • International. Cross-border shipments may be opened and inspected by customs; you are responsible for compliance with import laws.

5) Returns, Refunds & Exchanges

  • Food Items. For safety, opened food items are final sale and not returnable.
  • Unopened Items. If permitted by our published return policy, unopened items in original condition may be returnable within the stated window (contact us first for authorization).
  • Damaged/Incorrect. Contact us within 48 hours of delivery with photos if an item arrives damaged or incorrect so we can assist.
  • Return Shipping. Unless the return is due to our error or a defective product, you’re responsible for return shipping costs and safe packaging.
  • Refund Method. Approved refunds are issued to the original payment method; timing depends on your bank or provider.

6) Product Information, Allergens & Use

  • Accuracy. We aim to keep product information (ingredients, nutrition, origin, certifications) accurate, but details may change; always read labels, warnings, and directions before use.
  • Allergens. Our products may be processed, packed, or stored in facilities that also handle common allergens. If you have sensitivities, consult your healthcare professional and contact us with questions before purchase.
  • Storage & Handling. Follow storage and handling guidance on the label to maintain quality and safety (e.g., cool, dry conditions).
  • For Personal Use. Products are sold for lawful, personal use unless we explicitly agree in writing to wholesale or redistribution terms.

7) Wholesale, Bulk, Pallet & Container Orders (If Applicable)

  • Quotes & Terms. Bulk orders (pallets/containers) may require separate written terms (e.g., deposit, INCOTERMS such as CIF or FOB, lead times, quality specs).
  • Non-Cancellable. Once confirmed, bulk orders are typically non-cancellable and non-returnable, except for documented non-conformity per the written agreement.
  • Inspection. For shipments under CIF/FOB, risk allocation and inspection rights follow the agreed INCOTERM and contract.

8) Promotions, Gift Cards & Store Credit

  • Promotions. Promotional codes and offers are subject to their own terms and may be modified or ended at any time.
  • Gift Cards/Credit. Non-refundable, not redeemable for cash (except where required by law). Lost or stolen cards may not be replaced.

9) User Content (Reviews, Photos, Messages)

By submitting reviews, photos, testimonials, or other content (“User Content”), you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works for any lawful purpose (including marketing), in any media, without compensation. You represent that you own or control the rights to your User Content and that it doesn’t infringe, is accurate, and complies with these Terms.

We may remove or edit User Content at our discretion.


10) Acceptable Use

You agree not to:

  • Violate any law or third-party rights;
  • Upload malicious code or attempt to gain unauthorized access;
  • Interfere with or disrupt the Services;
  • Use the Services for scraping, data mining (except by standard search engines), or to build a competing service;
  • Misrepresent your identity or purchase for resale without our consent.

11) Intellectual Property

All content on the Services—including text, logos, trademarks, graphics, photos, videos, product names (“Mi Luv Food,” etc.), and software—is owned by or licensed to Grandfada and protected by IP laws. Except as expressly permitted, you may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent.


12) Third-Party Links & Tools

The Services may include third-party links, tools, or integrations (payments, analytics, shipping). We’re not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and governed by their terms.


13) Disclaimer of Warranties

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that product information is complete or current.


14) Limitation of Liability

To the fullest extent permitted by law, Grandfada, its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, business interruption, or replacement costs), arising from or related to your use of the Services or products, even if advised of the possibility.

Our total liability for any claim relating to a purchase will not exceed the amount you paid for the product(s) at issue.

Some jurisdictions do not allow certain limitations; in those cases, only the limitations lawful in your jurisdiction apply.


15) Indemnification

You agree to indemnify, defend, and hold harmless Grandfada and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, your violation of these Terms, or your violation of any law or third-party right.


16) Dispute Resolution, Governing Law & Venue

  • Good-Faith Resolution. Contact us first so we can try to resolve concerns informally.
  • Governing Law. These Terms and any disputes are governed by the laws of Jamaica, without regard to conflict-of-laws principles.
  • Arbitration. Except where prohibited by law, any dispute arising out of or relating to these Terms or the Services shall be finally resolved by confidential, binding arbitration in Kingston, Jamaica, before a single arbitrator, in English, under rules of a recognized arbitral body. Each party bears its own legal fees; administrative/arbitrator fees follow the applicable rules.
  • Injunctive Relief & Small Claims. Either party may seek injunctive or equitable relief in court for IP or data-security issues, and either party may pursue a claim in a court of competent jurisdiction for matters that qualify for small-claims.
  • Class Actions Waiver. To the extent permitted by law, disputes are resolved only on an individual basis; class, consolidated, or representative actions are not permitted.

If mandatory consumer law in your country/state requires a different governing law, venue, or process, those mandatory protections still apply.


17) SMS, Email & Electronic Communications (If Applicable)

  • Consent. If you opt in to SMS or email marketing, you agree to receive recurring messages; message/data rates may apply. Consent isn’t required to buy. Reply STOP to cancel, HELP for help.
  • E-Sign. You agree to receive agreements, notices, and disclosures electronically.

18) Privacy

Our Privacy Policy explains how we collect, use, and share personal information. It is incorporated into these Terms by reference.


19) Force Majeure

We are not liable for any delay or failure to perform due to causes beyond our reasonable control (e.g., acts of God, labor disputes, shortages, war, terrorism, epidemics/pandemics, governmental actions, failures of suppliers or carriers, or utility/internet outages).


20) Changes to the Services & to These Terms

We may update the Services and these Terms from time to time. Changes take effect when posted, unless a later date is specified. Material changes will be highlighted (and, where required by law, we’ll notify you). Your continued use after changes means you accept the revised Terms.


21) Miscellaneous

  • Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign your rights or obligations without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Entire Agreement. These Terms, together with any order confirmation and our Privacy/Returns policies, are the entire agreement between you and us regarding the Services and products.
